My fiance is in thousand of dollars in back child support. How much does this have to accumulate before a warrant is out for his arrest?How does warrant works in child support?

OK, technically, you cannot be arrested for having back Child Support. That’s a civil award. You can have a bench warrant issued for being in contempt of court (failing to pay your support). That varies by state. Some states have really cracked down and only being behind a month can get you a bench warrant issued.

Question by bowensnicole: How much back child support is required as payment if child support is suspended?
My husband and I share custody of our 18 year old. I have sole custody of our 13 year old. He owes 22065.63 in back child support. We agreed that child support will be suspended until the 18year old turns 21and then start back for the minor child. In the meantime he is to pay on the back child support. I am not sure how the payments go. Is it 20% like child support? How do they determine the amount paid on an outstanding amount?

Question by : how far back can you file for child support?
my mother-in-law wants to file for back child support and her kids are in their 40s now. they got divorced in 1976 or 1977 but the kids were put in a children’s home in 1977 when they were 9 and stayed there untill they were 14. she has never tryed to file before. so can she file for back support or not?

RoadFish.com men’s lifestyle and finance magazine today commented on the recent news of NBA Hall of Famer Dennis Rodman facing the possibility of 20 days in jail over failure to pay more than $ 850,000 in child and spousal support.

An article by Lauren Williams of the Daily Pilot stated Rodman faces up to 20 days of jail time over his failure to pay $ 808,935 in child support and $ 51,441 in spousal support to his third wife, Michelle Rodman. The numbers were provided in court documents written by Jack Kayajanian, Michelle Rodman’s attorney. According to the Daily Pilot article, Linnea Willis, Dennis Rodman’s attorney, stated in court documents that Rodman is barely able to support himself month to month and further stated that all of Rodman’s attorneys to date have worked pro bono on his case. An official court document filed by Willis stated, “Respondent Dennis Rodman is broke and cannot afford any additional fees.”

According to Sheila Marikar of ABC News, Dennis Rodman’s manager Darren Prince was quoted as telling ABC News that Rodman “has a well-documented drinking problem, and all the stress from the divorce and not seeing his kids isn’t helping. As people know, it’s a daily struggle. He has good days and bad ones, and good weeks and bad weeks.” Contrary to what Willis stated in Rodman’s court documents, Prince told ABC News, “He’s not hurting, compared to retired athletes, with what he makes, but he’s certainly not making what he made when he was paying with the Bulls.”

RoadFish.com’s Senior staff writer is quoted as saying, “I hate seeing one of my all-time basketball heroes facing jail time. I was a huge Bulls fan back in their hay day, and I honestly believe that Dennis Rodman is one of the greatest NBA rebounders to have ever lived. But sad to say I’m not totally surprised that he’s facing financial hardships right now. He is definitely known for being a party boy, and it kind of seems like it’s all catching up to him. I wish him the best and really hope that this issue can be resolved without any jail time.”

The above-mentioned Daily Post article states that court documents filed on Rodman’s behalf also claim that he is “extremely sick,” that his “marketability is diminishing,” and that Rodman paid more in child support than he actually earned this year. Rodman’s attorney stated, “Michelle Rodman has already been paid $ 13,500 this year, even though Dennis Rodman has only made $ 8,000 this year. The only way he is even able to keep up with support obligations is to borrow money from his finance manager… and his agent.”

RoadFish.com expressed a hope that the child and spousal support payments can be reconciled without the need for jail time. RoadFish.com’s Senior staff writer stated, “I’m not really sure how well off Rodman is at the moment, we seem to be getting varying information about his financial means at the moment. But having somebody pay $ 50,000 per month in child support fees is just outrageous. I sincerely hope that once Rodman gets past this hardship, he’ll get some help for his alcohol problems and turn his life around. It’s such a shame to see such talent go to waste.”

Rodman has played on NBA teams the Detroit Pistons, the San Antonio Spurs, the Chicago Bulls, the Los Angeles Lakers, and the Dallas Mavericks. Among his many honors are NBA All-Defensive First Team honors, which he won seven times, and NBA Defensive Player of the Year twice. Rodman was the top rebounder in the NBA for seven consecutive years (from 1991-1998,) and he won five NBA championships in his basketball playing days. He was inducted into the Naismith Memorial Basketball Hall of Fame in 2011.

Question by : Can a mother sue biological father for back child support if a different father is on birth certificate?
I have a daughter who is 7 and have always paid support to the mother. I am convinced she put another man’s name on the birth certificate. If I sue to get my name on the birth certificate can she sue me for back support. I stupidly paid her cash in the beginning and might not be able to prove that I paid her.

The name on the birth certificate is generally trumped by the results of a DNA (paternity) test. Get the court to order one. Also, child support in my state can only be back dated to the date of filing in court for child support.

My children’s dad owes over $ 30,000 in back support. He lives in Oregon. We live in Washington. He isn’t married and has no other dependents. If he filed his taxes on the April 2011 deadline how long will it take for us to get his refund? Will we be able to get his state tax refund too?
